Seperating a Mother from Her Child
Ibn al-Qayyim (ُرَحِمَه الله)
states: “Indeed, he, i.e. the legislator, ruled that the mother has more right
to the child than the father; and to live in close proximity with the ability
to meet at all times, if the father is given custody. He legislated that the
mother should not have to yearn for her
young one and informed that whoever seperates a mother from her child, Allāh will separate him from his loved ones on the Day of
Resurrection. He also prohibited selling a mother (female slave) without her
child or a child without his mother, even if they are in the same land. So how
is it permissible with this resolution to separate her from her child, a separation
making it difficult to see and meet with him, and difficult to have patience
with [the child’s] absence?”
